OVERVIEW:

All clip requests will be reviewed for approval. We reserve the right to deny a request due to the content of the footage requested or the context in which it will be used.

When a request has been approved, the requesting party will be contacted to quote the appropriate license fees for the rights requested and to confirm any information necessary. At that time a license agreement will be sent to the appropriate person for counter-execution along with an invoice for the license fees and transfer costs.

To accommodate the time constraints and deadlines of production, we accept faxed signatures. The license agreement will automatically be sent via fax for counter-execution, unless we are otherwise advised. We cannot release any broadcast quality material without a fully executed license agreement; therefore, the tape will not be ordered until the signed agreement has been returned. Please allow 1-2 weeks for delivery.




FEES & FORMATS:

Screener Fee
A VHS screener will be provided when requested for a fee of $500 per clip. If the clip is eventually licensed, the $500 will be applied toward the license fee.

Transfer Costs
In addition to the license fee there is a $300 charge for providing a broadcast quality tape.

Rush Fee
If you are on a strict deadline, we will order the tape immediately upon receipt of the signed license agreement for an additional $100 fee. In this case, you should receive the tape within 3 days of our ordering it.

License Fees
Broadcast license fees are determined based on the rights that are requested.

FAQs:

Who is the Licensee?
The Licensee is the party requesting the use of the clip and is the person or company responsible for all contract terms and residuals.


What if I don't know the air date?
Without an original air date, any and all information you can provide is extremely helpful in our search. Here are some examples:

a. The approximate time period or year.
b. Names of other guests who appeared on that show.
c. Was Mr. Carson hosting, or a guest host?


How long does this process take?
The length of time varies from request to request. Here are the most common factors that determine how long our process takes:

a. The more information we have about your clip, the quicker the process time. If we only have a vague description of the clip you've requested, the process may take longer.
b. Footage before 1973 is hard to come by. There are only a handful of clips available, which have to be searched for as well.
c. Footage will not be ordered until a fully executed license agreement is received. The sooner we have a signed agreement the sooner we can provide the footage.


Where is the footage?
The original footage is stored in a salt mine for preservation purposes. Once the clip has been identified and a fully executed license agreement has been signed, we request the video to be pulled from the salt mines, shipped to our offices and then sent out for duplication.


What footage is available?
Almost all of the footage from 1973 to 1992 is available. There are only a handful of clips available before 1973.


What formats are available?
We can fulfill almost every format requested. Please be specific when describing your desired format.


How much does it cost to license a clip?
There are several factors that go into the cost of license fees. Here are some examples:
a. The length of the clip requested: There is a per minute minimum rate for Tonight Show clips.
b. The rights requested by Licensee. License fees depend on the media, territory, term and number of runs requested.


How will License fees and rights be negotiated?
License fees and rights will be negotiated over the phone.


Can I view the clip before I commit to a contract?
The Screener Policy allows for the Licensee to view the requested clip on a VHS copy before committing to a contract. There is a non-refundable $500 per clip fee. If the clip is eventually licensed, the $500 will be applied toward the license fee.


What happens when my request has been approved?
When a request has been approved and the license fees have been negotiated, a license agreement will be faxed to the Licensee for a signature along with an invoice for license fees and transfer costs.


When can I get the footage?
When a fully executed license agreement is received, (via fax is accepted), the tape will be ordered.


How long does delivery take?
The tape will be shipped via Federal Express. Please allow 1-2 weeks for delivery. Or, you can request a RUSH shipping, for an additional $100. In this case you can expect the footage within 3 days.


When is payment due?
Payment is due upon receipt of the tape.


What forms of payment do you accept?
We only accept checks made payable to:
Carson Productions Group.


If I license the footage and then end up not using it in the final edit, am I still obligated to pay the license fee?
No. Simply inform us that it was not used in the final edit so we can note our records. However, the transfer costs of $300 for providing the broadcast quality tape will still be due.
